New Penal Code appropriate tool to handle juvenile violence

PHILIPSBURG - The highly expected new Penal Code for St. Maarten contains the tools needed to handle acts of juvenile violence such as what was witnessed on a school bus Monday morning.

Chief Prosecutor Hans Mos confirmed on Tuesday that the new tools are contained in the section called "Youth Penal Law."

Currently the law does not permit heavy punishment for the under-aged, only fines are permitted.

A child cannot be kept in custody, only for fact finding/investigation.

Another aspect to the case on Monday could be that of compensation for the victims.

Prosecutor Mos confirmed that this is possible under the law but that the request for compensation must be very clear or the case could be referred to the civil Judge in a civil case. More now via PodCast.
