Telem and SMCU to discuss retroactive payment for workers on call Print E-mail

PHILIPSBURG - The St. Maarten Communications Union (SMCU) had a successful day in court on Thursday in their case against Telem for a breach of their collective labour agreement (CLA).

According to the President of the (SMCU) Ludson Evers, the breach of the (CLA) began in 2006 and it had to do with the payment for workers who have been on call.

Evers stated that in 2006 the company had admitted that there was a misinterpretation of the (CLA) and that they were at fault with the payments to the workers.

The company was in the process of correcting the problems when the Managing Director left the company which resulted in the process being stalled.

Efforts to resume the talks with the new management proved to be unsuccessful and the union decided that the best way to settle the dispute was to go to court.

On Thursday the Judge ordered the parties to go back to the negotiating table and if this is not done, he will make a decision on the payment on the 17th of December.
