PHILIPSBURG - A pregnant mother of 3 was released Monday March 15, 2010, after spending more than 10 days on the floors of the policecells in Philipsburg.

The mother was arrested at the airport on March 4 because it was discovered that her passport and that of her 3 children were false.

Her husband, a local St.Maartener that had been married to the young lady for over 4 years saw his wife being locked up and his children sent to the local orphanage.

After 4 days in pretrial detention, the woman was released only to be immediately rearrested for immigration reasons.

The family contacted attorney at law Remco M. Stomp who immediately filed an injunction. The hearing was held on Friday, March 12, 2010.

Stomp argued that the only thing that was wrong with the situation was the fact that the passports were false, which in itself indeed was a crime. From that perspective it was understandable that an investigation was launched, Stomp said.

However keeping a pregnant young mother of three sleeping on the floor of the local police station was an obvious irresponsible thus unlawful measure taken by government.

Especially since there was no question about the identity of the mother and the children and the fact that she was lawfully married to a St. Maartener who also happened to be the father of the children, Stomp said.

Furthermore the mother had no criminal record. The passports from both the mother and her children were arranged by an acquaintance of the family in the Dominican Republic This acquaintance obviously turned out less reliable than thought.

The unfortunate happening was particularly sour for the family, for if the family had applied for their passports themselves they would have had no problem getting them.

The main legal technical argument however, that was presented to the judge, was the fact that the mother was officially still in possession of a valid residence permit and the law does not permit detention for immigration reasons if one is legally residing on the island, Stomp said. As a result the judge immediately ordered the release of the young mother.

Although the Governor initially intended to deport the young mother and revoke her residence permit, he has now launched an official investigation in the matter.

The judicial system on St.Maarten is so corrupted, the police of St. Maarten has
no morals nor values considering that they would only look at particular
evidence and not everything and would instead have the guts to put a pregnant
woman in the police cells in Philipsburg. How would they feel if this were to
happen to someone they considered family the tables would turn. This makes me
feel so disappointed and ashamed to say I am from St. Maarten

Stop blaming the govt, this woman has no respect for herself, her children, or
for sxm. I guess for years she has done things illegal in sxm and gotten away
with it. it is time to pay the piper, she brought this unto herself. she decided
to put that unborn child at risk, she is one of those that would get a boat with
her children. watch her.

Since she obviously was returning to SXM, from her home, the D.R., why didn't
she get her passport regulated herself? She is not too far in her pregnancy to
travel so she should have been able to drive to the Council to regulate her
affairs or at least submit the request or collect it when ready. Please don't
tell me they did not know.

Secondly, I do agree that she should not be locked
up, they should have locked up the husband instead for putting those children
through such an ordeal.

Here we go again, pity for everyone who breaks the Law
in SXM. What would they have done in the D.R. if a foreigner was caught with
false documents? Could someone tell me that? (And I sure they would not give
them a nice cot to sleep on either). Grace period, Brooks Tower were all a waste
of time. In no time Mr. Stomp and those like him will have immigrants from all
over living here, without legal documents and committing crimes, again. What
Period or Tower will we have next?

They should arrest the husband. How come did he NOT filed documents for his
wife to enter the island legally with his children after 4yrs of being
married??? I guess to have the freedom to buzz around with other women. SHAME

The Governor wanted to deport the woman.. is he serious?? married to a local
man... have permit.. did everything correct... all she did wrong was trust
someone to get her stuff... and the Governor wanted to kick her out???

I have
an idea Mr. Governor.. why don't you go on front street and ask the indians who
working in the stores who say they diamond setters or jewelry repair people to
set a stone or fix a watch... and if they can't deport them!!

anywhere in the world the same will happend so people let get serious. Go
japan/russia/germany/santo domingo/ USA with false papers and see what is going
to happend to you. We are thinking like this and we want to go to the new

SHE IS LEGALLY MARRIED TO A SXM MAN,she was not released
because she's pregant she is a legal resident.
now she should know her own
paisanos can't be trusted 100% so said she is not completely innocent so the
investigation must go on because she is not off the hook neither.
